Terms of Service & User Agreement

These terms govern your access to and use of the Pro Blanche Store service, plugin, and platform. Please read them carefully before activating your license or operating a connected store.

Introduction

Welcome to Pro Blanche Store, a connected store service operated by SoftMedia Ltd. (“we”, “us”, “the Operator”), headquartered in France. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “Store Owner”, “User”) and SoftMedia Ltd.

The service includes the Pro Blanche Store WordPress plugin (“Plugin”), the Hub digital product platform (“Hub”), the API delivery system, and all associated tools, dashboards, and documentation.

Read before use

Using any part of this service means you accept these Terms. If you disagree with any provision, you must not install the plugin, activate a license, or use the platform.

Eligibility

To use the Pro Blanche Store service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
  • Be a legal individual or duly constituted legal entity capable of entering into binding contracts.
  • Not be located in a country subject to international sanctions or trade embargoes.
  • Not have been previously suspended or terminated from the platform.
  • Provide accurate registration and contact information at all times.

Using the service on behalf of a company or organization means you represent that you have the authority to bind that entity to these Terms.

Account & License

Upon registration, you will receive a unique license key that activates your store’s connection to the Hub platform. This license is:

Activation location

Always activate from Pro Blanche Store → License in your WordPress admin panel. This is the only correct activation point.

You are responsible for maintaining the security of your account credentials and license key. Any unauthorized use of your account must be reported to us immediately at service@softmedialtd.com.

Acceptable Use

You agree to use the service solely for lawful, legitimate commercial purposes. The following are examples of acceptable use:

Operating a legitimate digital goods store selling properly licensed products.
Selling physical products you own, manufacture, or are authorized to resell.
Using Hub Sync to import authorized digital inventory from the platform.
Customizing your store appearance using the provided settings and tools.
Contacting support for technical assistance with your licensed installation.

The following behaviors are expressly prohibited regardless of intent:

Circumventing API rate limits, delivery controls, or stock restrictions.
Creating fake orders or simulating deliveries to manipulate order statistics.
Using automated bots to scrape, probe, or overload the platform infrastructure.
Running multiple accounts to abuse free plans or bypass account-level restrictions.
Misrepresenting product origin, condition, or legitimacy to end customers.

Prohibited Products

Zero Tolerance — Immediate permanent ban

Attempting to list, sell, or facilitate the sale of any item in this section results in immediate permanent account termination and may be referred to law enforcement.

Counterfeit or stolen digital codes — Game keys, software licenses, gift cards, or vouchers obtained through fraud, theft, or unauthorized generation.
Compromised or hacked accounts — Gaming, streaming, or service accounts obtained through phishing, credential stuffing, or unauthorized access.
Products funded by stolen payment methods — Any item purchased using fraudulent, unauthorized, or stolen payment credentials before resale.
Pirated or cracked software and media — Software, games, films, or music distributed without valid copyright authorization.
Illegal weapons, firearms, or explosives — Unlicensed weapons, ammunition, parts, or manufacturing instructions.
Illegal drugs or controlled substances — Products that facilitate, promote, or enable drug acquisition or distribution.
Child sexual abuse material (CSAM) — Any product, content, subscription, or file involving child exploitation. This violation will be reported to relevant authorities without exception.
Malware, exploit kits, or hacking tools — Software or scripts designed to cause harm, gain unauthorized access, or compromise systems.
Counterfeit identity documents — Forged passports, IDs, diplomas, certificates, or any official documents.
Money laundering instruments — Using digital product sales to disguise, convert, or transfer proceeds of criminal activity.
Products under international sanctions — Goods or services sold to sanctioned individuals, entities, or countries.
Deceptive subscription traps — Services misrepresented to end customers that trigger undisclosed recurring charges.
Human trafficking facilitation — Any product or service enabling or profiting from human trafficking in any form.

Store Owner Responsibilities

As a store owner using Pro Blanche Store, you are solely and fully responsible for:

  • The legal compliance of every product listed on your store.
  • Accurate product descriptions, pricing, stock levels, and delivery timeframes.
  • Publishing and honoring a clear refund, delivery, and return policy for your customers.
  • Compliance with all applicable local, national, and international e-commerce, consumer protection, and tax laws.
  • Implementing HTTPS/SSL on all pages of your WordPress store.
  • Responding to customer disputes within a reasonable timeframe (maximum 48 business hours recommended).
  • Maintaining your WordPress installation, plugin, and connected software in an updated and secure state.
  • Never storing customer payment card data outside of PCI-compliant payment gateways.
Your store, your responsibility

SoftMedia Ltd. provides the platform infrastructure only. You remain solely responsible for the legal and operational conduct of your store and for all interactions with your end customers.

Digital Products & API Delivery

Digital products are sourced from the Hub platform and delivered through an automated API system. Delivery behavior depends on stock availability at the time of purchase:

Store owners must not list digital products they know, or reasonably should know, to be sourced illegally or without authorization. You remain responsible for ensuring all listed digital products have legitimate resale authorization.

Physical Products & Fulfillment

Physical products are added and managed directly on your WordPress store. The platform does not warehouse, ship, or handle physical goods in any capacity. You are entirely responsible for fulfillment.

  • All physical products must comply with applicable product safety regulations in the country of sale.
  • Product condition (new, used, refurbished) must be accurately disclosed in the listing.
  • Estimated delivery timeframes and shipping costs must be communicated before checkout.
  • You must hold any import/export licenses required for cross-border shipments.
  • After an order is placed, you must manually confirm, prepare, ship, and update the order status.
No auto-delivery for physical products

Physical orders are never fulfilled automatically. Failure to fulfill physical orders may result in chargebacks, customer disputes, and account suspension.

Payments & Platform Fees

Platform access fees are charged according to the plan selected at registration. All fees are listed in euros (€) and are subject to applicable VAT. Fees are due in advance and non-refundable except as explicitly set out in Section 10.

You agree not to initiate chargebacks or payment disputes against SoftMedia Ltd. for fees that correspond to services actively delivered. Chargeback fraud is a violation of these Terms and may result in account termination and legal action.

Fraudulent chargebacks

Using chargebacks to obtain free services or products will be treated as fraud. Affected accounts will be permanently suspended and reported to payment processors.

Refund Policy

Platform subscription refunds

Refund requests for platform subscription fees must be submitted within 7 calendar days of payment. No refund will be granted if the license has been activated and used to operate a store or sync products.

End customer refunds (your store)

You are responsible for defining and honoring your own refund policy with your end customers. As a general rule under EU consumer law:

  • Digital products that have been accessed, downloaded, or codes that have been revealed are generally non-refundable once delivery is confirmed.
  • Physical products may be subject to a 14-day return right for EU consumers (distance selling regulations).
  • You must publish a clear refund policy on your store before accepting payments.

Intellectual Property

The Pro Blanche Store name, logo, platform design, plugin code, API structure, and all associated intellectual property are the exclusive property of SoftMedia Ltd. and are protected by applicable intellectual property laws.

Using the Pro Blanche name or logo in a way that implies official affiliation or endorsement without written consent.
Reproducing, distributing, or creating derivatives of the plugin or platform code.
Claiming ownership of platform features, interface designs, or API architecture.

You retain ownership of all original content you independently create for your store (product descriptions, images, brand elements). You grant SoftMedia Ltd. a limited, royalty-free license to display this content solely for operational service purposes.

Privacy & Data Protection

SoftMedia Ltd. processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable French data protection law. We collect only the data necessary to provide the service: license identifiers, store domain, API usage logs, and contact information. No payment card data is stored on our servers.

As a store owner, you are an independent data controller for your end customers’ personal data. You are responsible for:

  • Maintaining a GDPR-compliant privacy policy on your store.
  • Obtaining appropriate consent from your customers for data collection and marketing.
  • Never sharing customer data with unauthorized third parties.
  • Implementing appropriate technical measures to protect customer data.

Your rights regarding data we hold about you include: access, correction, deletion, portability, and the right to object to processing. Contact service@softmedialtd.com to exercise these rights.

Disclaimer of Warranties & Liability

The Pro Blanche Store service and plugin are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

SoftMedia Ltd. does not guarantee that the service will be error-free, secure, or available at all times. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including loss of revenue, data, or business opportunities.

You agree to defend, indemnify, and hold SoftMedia Ltd. and its officers, employees, and partners harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: your violation of these Terms, your store’s operations, any products you sell, or your infringement of any third-party rights.

Termination

SoftMedia Ltd. reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any breach of these Terms or for conduct that harms the platform, other users, or third parties.

Upon termination, all platform access is revoked immediately. Account data may be retained for up to 30 days then deleted, except where retention is required by law. Outstanding fees remain due after termination.

Governing Law & Disputes

These Terms are governed by and construed under the laws of France, without regard to conflict of law provisions. Any dispute shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to the competent courts of France.

EU-based consumers retain the right to bring claims before the courts of their country of residence and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

SoftMedia Ltd. reserves the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
